PRIVACY POLICY AND TERMS OF USE

This document regulates the download, access and use of the ASES VITAL mobile application (hereinafter, the "APPLICATION"), which the Health Insurance Administration (hereinafter, "ASES") makes available to users.

This version of ASES VITAL is available free of charge.

Access to the ASES VITAL application implies that the user acknowledges, has accepted and unreservedly consented to the present conditions of use.

1. OBJECTIVE

The purpose of the APPLICATION is to allow users to:

  • Access the Plan VITAL card in virtual format.
  • Know the eligibility status, effective date, expiration date, insurer (MCO), primary medical group (PMG) and primary care physician (PCP).
  • Search health care providers by insurer affiliation, primary medical group and geographic location.
  • Schedule a virtual appointment with the Enrollment Counselor.
  • Receive automatic alerts and messages about insurance carrier changes, recertification reminders, events and the open enrollment period.
  • Send messages to the Enrollment Counselor for questions, health care providers, and appointments.
  • Locate the nearest Medicaid offices and fastest routes.
  • Submit Recertification Application and send evidence documents.
  • Get answers to Frequently Asked Questions related to the ASES VITAL mobile application, VITAL Plan insurers and the certification and recertification process.

This project is for the benefit of the general public. The design and development of this APPLICATION has involved ASES staff, application engineers, professional specialists, as well as a group of users who participated in the testing period.

The APPLICATION is made available to users for their personal (never business) use. It works on an Android or iOS mobile device.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The intellectual and industrial property rights over the APPLICATION are owned by the Health Insurance Administration, which has the exclusive exercise of the rights to exploit them in any form and, in particular, the rights of reproduction, distribution, public communication and transformation.

The user acknowledges that the reproduction, modification, distribution, commercialization, decompilation, disassembly, use of reverse engineering techniques or any other means to obtain the source code, transformation or publication of any result of unauthorized reference tests of any of the elements and utilities integrated within the development constitutes an infringement of the intellectual property rights of the Health Insurance Administration, and consequently undertakes not to carry out any of the aforementioned actions.

3. PRIVACY POLICY

The Health Insurance Administration may use the personal information you provide to us in a dissociated form (without personal identification) for internal purposes, such as the elaboration of statistics. The APPLICATION may collect, store or accumulate certain non-personal information regarding its use.

In accordance with the provisions of the state and federal regulations in force regarding the protection of personal and health data, it is hereby informed that the personal data provided through the acceptance of this Privacy Policy and Terms of Use shall be part of an encrypted file and that these shall be processed for the purpose described for the users of the Health Insurance Administration.

ASES reserves the right to make, at any time and without prior notice, modifications and updates to the APPLICATION. Likewise, it also reserves the right to modify the present Terms and Conditions with the purpose of adapting them to the possible legislative novelties and changes in the APPLICATION itself, as well as to those that may be derived from the existing standard codes on the subject or for strategic or programmatic reasons.

4. EXCLUSION OF LIABILITY

ASES reserves the right to edit, update, modify, suspend, eliminate or terminate the services offered by the APPLICATION, including all or part of its contents, without prior notice, as well as to modify the form or type of access thereto.

The possible causes of modification may occur for reasons such as adaptation to possible legislative developments and changes in the Application itself, as well as those that may arise from the existing standard codes on the subject or for strategic or programmatic reasons.
